Gorontalo Electoral District PSU 6: Party Must Meet 30% Women’s Quota

The Constitutional Court (MK) ordered re-voting (PSU) at all Gorontalo 6 electoral district polling stations for the Provincial DPRD legislative elections. This is the result of the four parties, namely, the Gerindra Party, PKB, NasDem, and the Democratic Party, not meeting the minimum 30 percent women’s candidacy quota requirement in the electoral district.

“In the Constitutional Court’s decision, only four parties did not meet the percentage of women’s representation according to the legal considerations of the Constitutional Court’s decision. “So that’s what we will ask the party to do to implement the 30 percent requirement for women in their electoral districts,” said the Head of the Indonesian KPU Technical Division, Idham Holik (13/6).

This was decided by the Constitutional Court in the hearing to pronounce the decision on the 2024 legislative election results dispute (PHPU) with Case Number 125-01-08-29/PHPU.DPR-DPRD-XXII/2024, which was requested by PKS. Apart from ordering the PSU, through this decision, the Constitutional Court also annulled KPU Decree Number 360 of 2024 concerning the Determination of the Results of the Presidential Election and Members of the DPR, DPD, Provincial, Regency, or City DPRD Nationally in the 2024 Election as long as it concerns the vote acquisition of candidates for the Gorontalo Provincial DPRD for Dapil Gorontalo 6.

“In the future, for the next elections for electoral districts that do not meet the minimum requirement of 30% female candidates, the KPU orders political parties participating in the elections to improve their list of candidate members,” said Deputy Chief Justice of the Constitutional Court, Saldi Isra, when reading out the legal considerations at the Constitutional Court Building, Jakarta.

Before the PSU was held, the Constitutional Court asked the KPU to order political parties participating in the Gorontalo DPRD legislative election in Dapil Gorontalo 6, which did not meet the minimum requirements for female candidates, to improve their candidate lists with at least 30 percent female candidates. The Constitutional Court gave the PSU vote results a maximum of 45 days from the time the decision was pronounced. []
