MK will handle 297 cases in the 2024 PHPU legislative elections

The Constitutional Court (MK) registered 297 cases regarding the 2024 Legislative General Election Results Dispute (PHPU). These cases consisted of PHPU for members of the DPR, DPD, Provincial DPRD, and Regency/City DPRD. The preliminary examination agenda hearing is scheduled to be held on April 29–3, 2024, in parallel in three courtrooms of the Constitutional Court.

“Of the 297 cases, if broken down by province, Central Papua is the province with the most PHPU cases in the 2024 Legislative Election, namely 26 cases,” wrote the MK in a press release (29/4).

Furthermore, if broken down based on the type of submission, there were 285 DPR/DPRD cases and 12 DPD cases. Of the 285 DPR/DPRD cases, 171 were submitted by political parties, and 114 were submitted by individual applicants. There were 74 cases filed by individuals for Regency/City DPRD PHPU, 28 provincial DPRD cases, and 12 DPR RI cases.

“The Gerindra Party and the Democratic Party are the political parties participating in the elections that have filed the most cases, namely 32 cases each,” explained the MK.

Meanwhile, the 12 PHPU DPD 2024 cases cover 9 provinces, namely Central Papua, South Papua, and Riau, with 2 cases each. Maluku, North Kalimantan, East Nusa Tenggara, West Nusa Tenggara, West Sumatra, and North Sumatra have one case each.

In accordance with statutory provisions, the Constitutional Court is given time to complete legislative PHPU cases no later than 30 working days after the case is recorded in e-BRPK. Meanwhile, referring to Constitutional Court Regulation Number 1 of 2024, the Constitutional Court will decide on the case in question no later than June 10, 2024.

The case examination will be carried out by a panel of three judges consisting of three constitutional justices. Panel I consists of Suhartoyo (the panel chair), Daniel Yusmic Foekh, and Guntur Hamzah. Meanwhile, panel II consists of Saldi Isra (panel chair), Ridwan Mansyur, and Arsul Sani. Then panel III consisted of Arief Hidayat (panel chair), Anwar Usman, and Enny Nurbaningsih.

“For the distribution of handling the number of cases, Panel I examined 103 cases, and Panel II and Panel III each examined 97 cases,” he explained. []
